VICTORIA
In Victoria there are 2 types of courses; Agent's Rep. Courses and Licensing Course.
The Agent's Rep. Course, when successfully completed, provides you with the educational requirements to work as an Agent's Representative in Victoria.
An agent’s representative is an employee of a licensed estate agent who performs any of an estate agent’s functions ‑ for example, a salesperson or property manager ‑ under the authority of that agent.
An agent’s representative cannot operate a real estate business.
The Licensing Course, when successfully completed, provides you with the educational requirements to become an Estate Agent in Victoria.
The role of an estate agent is to:
- act on behalf of owners, buyers and tenants to arrange the sale or lease of property including houses, buildings, factories, shops, farms, land and businesses
- provide market appraisals of properties and businesses for clients
- negotiate the sale or lease of properties and businesses
- prepare agreements between buyers and sellers or landlords and tenants
- collect rents and manage rental properties.
To do any of these you must:
- hold an estate agent’s licence, or
- be employed by a licensed estate agent as an agent’s representative.
NEW SOUTH WALES
In New South Wales there are 2 types of courses; Registration Courses and Licensing Course.
The Registration Course, when successfully completed, provides you with the educational requirements to work as a Real Estate Salesperson in New South Wales.
A certificate of registration as a real estate salesperson is issued to a person who is employed by a licensed Real Estate Agent involved in the sale and or leasing of land up to 20 hectares.
Persons holding a Certificate of Registration can only act under the supervision of an appropriately licensed real estate agent.
The Property, Stock and Business Agents Act 2002 requires those commencing work in the industry are required to apply for a certificate of registration.
The Licensing Course, when successfully completed, provides you with the educational requirements to become a Real Estate Agent in New South Wales.
For licensing purposes, the work of a real estate agent includes the sale (including by way of auction), purchase, exchange, letting or leasing of real estate.
The Property, Stock and Business Agents Act 2002 requires anyone who wishes to carry on business as a real estate agent, to have a licence.
QUEENSLAND
In Queensland there are 2 types of courses; Registration Courses and Licensing Course.
The Registration Course, when successfully completed, provides you with the educational requirements to work as a Real Estate Salesperson in Queensland.
Note: If you work for a real estate agency as a contractor or sub-contractor, you must have a full real estate agent licence, not just a registration certificate.
This registration certificate allows you to do any of the following activities that your real estate agent employer is allowed to do:
- buy, sell, exchange or let places of residence, business or land, or interests in them
- collect rent
- negotiate for the buying, selling, exchanging or letting of residences
- transact or negotiate property sale or rental
- show property
- inspect or appraise property for sale or rent
- advertise, place a sign or conduct an open for inspection on a property for sale or rent
- buy, sell or exchange livestock or an interest in livestock.
You cannot:
- operate trust accounts
- be the person in charge at a place of business.
The Licensing Course, when successfully completed, provides you with the educational requirements to become a Real Estate Agent in Queensland.
The real estate agent licence allows you to:
- buy, sell, exchange or rent houses, businesses, land or any interest in these
- negotiate for the buying, selling, exchanging or renting of houses, businesses or land
- show property to potential buyers
- inspect and assess property for sale or rent
- advertise a property for rent or sale (includes setting up signs)
- open up a property for inspection for sale or rent
- manage an apartment complex and sell any units independently, without having to work through an established agency
- operate a trust account on behalf of sellers and buyers
- buy, sell or exchange livestock or an interest in livestock.
own or manage a real estate agency
You cannot:
- auction property.
WESTERN AUSTRALIA
In Western Australia there are 3 types of courses; Sales Representative Course, Property Manager Course and Licensing Course.
The Sales Representative Course, when successfully completed, provides you with the educational requirements to work as a Sales Representative in Western Australia.
The Real Estate and Business Agents Act 1978 requires people wanting to work in Western Australia as a real estate and business sales representative must be registered with Consumer Protection. A sales representative must work under the supervision of a licensed real estate and business agent.
While the Property Manager Course, when successfully completed, provides you with the educational requirements to work as a Property Manager in Western Australia.
The Licensing Course, when successfully completed, provides you with the educational requirements to become a real estate agent.
On behalf of clients, a licensed real estate agent can lease, buy and sell private or commercial property and a business agent can buy and sell businesses. An agent can be licensed as a real estate agent and a business agent at the same time. The holder of a licence must also hold a current triennial certificate in order to carry on business in the industry. REBA issues applicants with a triennial certificate at the time a licence is granted. The triennial certificate is then subject to renewal every three years.
SOUTH AUSTRALIA
In South Australia we offer the Land Agent’s Course.
The Land Agent’s Course, when successfully completed, provides you with the educational requirements to Register as a Land Agent in South Australia.
Any person (including a company) who carries on business, or who holds himself or herself out as a land agent, must be registered under the Land Agents Act 1994.
